Terms of Service

These Terms govern your use of sqword (the "app"), operated by FUNKARNU SL ("we", "us"). By creating an account or using the app you agree to these Terms. If you don't agree, please don't use the app.

1. Who can use sqword

You must be at least 13 years old to use sqword. If you live somewhere with a higher digital-consent age (for example, 16 in parts of the EU), you must meet that age.

When using sqword, you agree not to:

We may remove content, suspend accounts, void scores, or permanently ban accounts that break these rules. Where the violation is also a Privacy Policy or applicable-law matter, we may report it to the relevant authorities.

4. Game content and intellectual property

sqword, including the name, logo, artwork, gameplay design, source code, dictionaries, and all other materials produced by FUNKARNU SL, is protected by copyright and other intellectual-property laws. We grant you a personal, non-exclusive, non-transferable licence to use the app on your own devices for your personal, non-commercial enjoyment. Nothing in these Terms transfers ownership.

Words submitted to the dictionary are not your property and not ours individually — they're part of the public language. Match boards you create are yours; by playing online you grant us a licence to display them to your opponent and, in aggregate and anonymised form, to operate the game.

5. Beta status

sqword may be made available in beta or pre-release form. During those periods features can change, scores can be reset, match history can be wiped, and outages are likely. By participating you accept that risk and agree not to publicly share unreleased content or builds.

6. Third-party services

sqword uses Firebase (Google) and Cloudflare to operate. Your use of those services through the app is also subject to their own terms. We do our best to pick providers that take privacy and reliability seriously, but we're not responsible for their outages, policy changes, or independent actions.

7. Disclaimers

sqword is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise the app will be uninterrupted, error-free, or that it will match your expectations.

8. Limitation of liability

To the maximum extent permitted by law, FUNKARNU SL will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or in connection with sqword. Our total liability for any direct damages will not exceed the amount you paid for the app in the 12 months before the claim, or, if sqword is free, EUR 50.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for gross negligence or wilful misconduct, or statutory consumer rights).

9. Termination

You can stop using sqword and delete your account at any time. We can suspend or terminate your account if you materially break these Terms or our Privacy Policy, or if we need to comply with a legal request. Sections 4 (IP), 7 (Disclaimers), 8 (Liability), and 11 (Governing law) survive termination.

10. Changes

If we change these Terms in a material way, we'll update the "Last updated" date above and, when appropriate, notify you in-app. Continued use of sqword after a change means you accept the new Terms.

11. Governing law and disputes

These Terms are governed by the laws of Spain, without regard to its conflict-of-laws principles. Disputes will be handled by the courts of Spain, unless your local consumer-protection law requires otherwise.
